Elegant Ebony provides services to you subject to the notices, terms, and conditions set forth in this agreement.
Elegant Ebony reserves the right to change this site and these terms and conditions at any time. Before proceeding, please read this agreement because accessing, browsing, or otherwise using the site indicates your agreement to all its terms and conditions.
You shall not upload, distribute, or otherwise publish through this site any content, information, or other material that (a) includes any bugs, viruses, worms, trap doors, trojan horses, or other harmful code or properties; (b) is libelous, threatening, defamatory, obscene, indecent, pornographic, discriminatory, or could give rise to any civil or criminal liability under the laws of the U.S. or the laws of any other country that may apply; or (c) violates or infringes upon the copyrights, patents, trademarks, service marks, trade secrets, or other proprietary rights of any person. Elegant Ebony may give you an account identification and password to enable you to access and use certain portions of this site. Each time you use a password or identification, you are deemed to be authorized to access and use the site in a manner consistent with the terms and conditions of this agreement, and Elegant Ebony has no obligation to investigate the source of any such access or use of the site.
By accepting these terms of usage through your use of the site, you certify that you are 18 years of age or older. If you are under 18 years old please use this site only under the supervision of a parent or legal guardian. Subject to the terms and conditions of this agreement, Elegant Ebony hereby grants you a limited, revocable, non-transferable, and non-exclusive license to access and use the site by displaying it on your internet browser only for the purpose of shopping and not for any commercial use or use on behalf of any third party, except as explicitly permitted by Elegant Ebony in advance. Any violation of this Agreement shall result in the immediate revocation of the license granted in this paragraph without notice to you.
Unless explicitly permitted by Elegant Ebony in advance, all materials, including images, text, illustrations, designs, icons, photographs, programs, music clips or downloads, video clips and written and other materials that are part of this site (collectively, the “Contents”) are intended solely for personal, non-commercial use. You may not make any commercial use of any of the information provided on the site or make any use of the site for the benefit of another business. Elegant Ebony reserves the right to refuse service, terminate accounts, and/or cancel orders in its discretion, including, without limitation, if Elegant Ebony believes that customer conduct violates applicable laws or is harmful to Elegant Ebony’s interests. You may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile, or otherwise exploit this site or any portion of it unless expressly permitted by Elegant Ebony in writing.
You will be solely responsible for all access to and use of this site by anyone using the password and identification originally assigned to you whether or not such access to and use of this site is actually authorized by you, including without limitation, all communications and transmissions and all obligations (including without limitation financial obligations) incurred through such access or use. You are solely responsible for protecting the security and confidentiality of the password and identification assigned to you. You shall immediately notify Elegant Ebony of any unauthorized use of your password or identification or any other breach or threatened breach of this Site’s security.
Elegant Ebony sincerely respects property rights. In case there is a copyright infringement on any picture, please contact us, and we will remove the picture as soon as possible.
User account
For safety and security, each customer is allowed to create only one registered account by default. For customers who attempt to create several accounts, Elegant Ebony reserves the right to suspend accounts without further notice. Both parties agree that, following order dispatch, transportation is the sole responsibility of the third-party logistics company. During this stage, full ownership of the product(s) belongs to the buyer; all associated liability and risks during transportation shall be borne by the buyer.
In accordance with customs regulations, customers must provide valid and accurate data. All consignee names, address and payers name should be valid. Certain countries request that the consignee submit their ID or passport to clear the package or for payment verification purposes. It is the customers sole responsibility for the accuracy of data that they provide to us. Should any information be incorrect and prevent any shipment or deliveries or customs clearance, we will not held responsible and will not offer any compensation in such cases. Elegant Ebony will always comply with the law, and we kindly remind users to do the same. As the importer customers are responsible to comply with all laws and regulations in their own countries. Please refer to our privacy policy for more information.
Order Acceptance
Please note that there may be certain orders that we are unable to accept and must cancel. Elegant Ebony reserves the right, at sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order.
Elegant Ebony is not responsible for late deliveries for special occasions, such as birthdays, or other events. We encourage customers to place their order in advance to ensure there is enough time to receive their item. All orders reported as delivered by shipping companies are considered delivered. Elegant Ebony cannot be made liable of non-delivery in this case.
Reviews and Comments
Except as otherwise provided elsewhere in this Agreement or on the site, anything that you submit or post to the site and/or provide Elegant Ebony, including without limitation, ideas, know-how, techniques, questions, reviews, comments, and suggestions (collectively, “Submissions”) is and will be treated as non-confidential and nonproprietary, and by submitting or posting, you agree to irrevocably license the entry and all IP rights related thereto (excluding the moral rights such as authorship right) to Elegant Ebony without charge and Elegant Ebony shall have the royalty-free, worldwide, perpetual, irrevocable, and transferable right to use, copy, display, publish, transmit, adapt, create derivative works from such Submissions by any means and in any form, and to translate, modify, reverse-engineer, disassemble, or decompile such Submissions. All Submissions shall automatically become the sole and exclusive property of Elegant Ebony and shall not be returned to you and you agree not to raise any dispute in connection with any use of the entry by Elegant Ebony in the future. You warrant that your Submissions, in whole or in part, are clear and free of any IP right infringement, disputes or third party claims. Elegant Ebony assumes no liability for any misuse of copyright or any other rights of third parties by you. You undertake to defense for and indemnify the Sponsor against any losses caused due to the use of the entries for any purposes.
In addition to the rights applicable to any Submission, when you post comments or reviews to the site, you also grant Elegant Ebony the right to use the name that you submit with any review, comment, or other Content, if any, in connection with such review, comment, or other content. You represent and warrant that you own or otherwise control all of the rights to the reviews, comments, and other content that you post on this site and that use of your reviews, comments, or any other content by Elegant Ebony will not infringe upon or violate the rights of any third party. You shall not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead Elegant Ebony or third parties as to the origin of any submissions or content. Elegant Ebony may, but shall not be obligated to, remove or edit any submissions (including comments or reviews) for any reason.
Transportation
Unless otherwise provided, Elegant Ebony shall use its judgment in determining carrier and routing. In either case, we shall not be liable for any delays or excessive transportation charges resulting from its selection.
Payment Terms
The discount applies only to the invoiced value of the material (not to taxes or freight charges). Elegant Ebony reserves the right to require advance payment or satisfactory security for the goods if the financial condition of Buyer so warrants as determined by Elegant Ebony. If customer fails to make payment in accordance with terms of this agreement or any collateral agreement or fails to comply with any provisions hereof, Elegant Ebony may, at its option (and in addition to other remedies), cancel any unshipped portion of this order. Customer is to remain liable for all unpaid accounts.
Taxes
Prices do not include taxes. Taxes are paid by customer at the time of purchase from Elegant Ebony, if applicable.
Refund/Return Policy
At Elegant Ebony, our customers are our number one priority. If an order is inaccurate, please contact our Customer Service Department immediately since all orders must be returned within 7 days of the customer’s receipt date.
All items must be returned in original factory condition i.e. unaltered, unworn, and undamaged with original packaging and tags attached. Please ensure that the hair bundles, closures and/or frontals are intact and the lace and bundles have not been cut, altered, washed, damaged, dyed or bleached.
Prior to returning any items, the customer must contact the Customer Service Department at customerservice@elegantebony.com to obtain a Return Merchandise Authorization. Please include the customer’s email address and order number within your email request to the Customer Service Department. Once the return has been authorized, the item(s) will be allowed to be returned.
If the order was fulfilled accurately by Elegant Ebony, the customer is responsible for the return shipping charge.
However, if it is determined that the customer was inadvertently sent the wrong hair product, Elegant Ebony will be responsible for the return shipping charge.
Once the returned package is received and inspected and it has been determined by all item(s) are found to be free of damage, alterations, and wear with original packaging and tags attached, a refund will be processed and automatically applied to the customer’s original payment account minus any applicable return shipping charges, when necessary.
